I graduated from The University of Glasgow in 1973, BSc(Eng); worked for Westland Helicopters until 1984, during which time I became a
Chartered Engineer (CEng); worked for Strathclyde University for three years;
and then set up Herrick Brown & Company Ltd. The main workload of the
business involves consultancy and support for clients with complex database
systems.
I have undertaken the training courses of The Academy of Experts.
I completed my first assignment as an expert in 1988, and
have had a steadily increasing number of assignments over the intervening
years.
That first case involved a business that had purchased a computer system described in writing by the vendor as ideally suitable for the business's needs, but which failed to meet those needs. The case settled in favour of the business, two minutes prior to entering the Court.
I have since acted for both vendors and purchasers of allegedly defective computer hardware and software; for customers dissatisfied with the services provided by computer businesses; and for defendants in criminal cases involving computers in all their guises including the internet. A number of appointments have come from solicitors acting for legal expenses insurers, and some have been Court appointments as a single joint expert.
I have assisted insolvency practitioners with the computer related aspects of failed businesses, including a case in which the directors were found guilty of failing to keep proper accounts despite claiming that they had used a computer system.
I was surprised when I was asked to assist with a divorce; however the computer discs passed to me did not as hoped hold the other party's accounts information.

Two cases of fraud involving the tills and stock of licensed premises.
A criminal case about the computers used in the altering of the IMEI numbers of mobile phones. pdf
Acting as a Court approved Single Joint Expert (SJE) in a dispute between a web site developer and the client. The developers were found to be at fault and damages and costs were awarded against them. pdf
A criminal case involving proving that a digital camera had been used to make incriminating images found on a computer. pdf
Acting as a Court approved SJE in a dispute between a customer and a large retail business over a faulty computer system. pdf
A dispute between a customer and a computer service business over data loss caused by poor workmanship. My client, the Claimant, won a significant settlement in Court. pdf
A criminal case involving indecent telephone calls and the source telephone number.
Acting for a computer supplier seeking payment of invoices for supply of hardware, wrongly, as I reported, claimed to be faulty. html
A criminal case involving the use of incriminating material searched for on the internet. html
I am happy to act as a Single Joint Expert, as a Party Appointed Expert, or as an Adviser (shadow expert).
One of the most significant judgments for Experts involved with computer related cases is Anglo Group plc -v- Winther Brown & Co Ltd and BML (Office Computers) Ltd.
